Hollesley Bay prisoner accused of sexually assaulting patient at Ipswich Hospital while being treated for cancer

A prisoner sexually assaulted a female patient at Ipswich Hospital while he waited to be picked him up after receiving treatment, it has been alleged.

John Smith, 50, was a serving prisoner at HM Hollesley Bay near Woodbridge and on December 14, 2014 he was released on day licence to go to the hospital in relation to ongoing treatment for cancer, Ipswich Crown Court was told.

He was taken to the hospital by prison van and after his appointment finished at 10.30am Smith asked a receptionist to contact the prison to get him a lift back, said Jane Oldfield, prosecuting.

She claimed that while Smith was waiting to be picked up he had sexually assaulted a woman patient who had gone outside for a cigarette.

Smith had allegedly sat down next to the woman, who was wearing a hospital gown, and after a brief conversation with her he allegedly started making sexual comments and touched her leg.

The woman pushed his hand away and tried to stand up but Smith allegedly held on to her dressing gown and put his hand up her hospital gown and touched her thigh.

The woman got away and returned to her ward where she told a nurse what had happened.

Shortly afterwards Smith had allegedly gone to the ward and told staff he was a friend of the woman’s mother and had come to visit her.

Smith was asked to leave the ward by a doctor and a nurse who were aware of what had allegedly happened and the police were called.

Smith has denied sexually assaulting the woman. After his arrest he denied having any contact with the alleged victim and claimed it was a case of mistaken identity.

Giving evidence the alleged victim claimed that Smith told her: “When I have sex with you, you will like it.”

She said that when she pushed Smith away and told him not to touch her he smiled and laughed at her.

The trial continues today.
