A YOUNG girl who suffered a catastrophic brain injury at birth will receive a pay out of £4.5million after Ipswich Hospital admitted liability for her injuries.

The 11-year-old, who is from Ipswich but cannot be identified for legal reasons, was left with lasting brain damage and various serious disabilities after complications arose during her birth at the Heath Road trust in 2001.

Through her mother, the youngster sued Ipswich Hospital, claiming damages for the injuries she suffered and financial support to provide for a lifetime of care.

The trust admitted full liability for the girl’s injuries and agreed to the payout - made up of a lump sum of £1.9m, plus annual index-linked and tax-free payments for the rest of her life - which was today approved at London’s High Court.

Speaking on behalf of the trust, Margaret Bowron QC, told the court the trust was pleased the settlement had been reached without the need for a trial and hoped it would bring peace of mind to the girl and her family.

She added: “This little girl is a delightful, well-rounded and resourceful girl who has made the absolute best of all that life has thrown at her.

“We are sure that this is due in no small measure to the loving care that her parents have shown her and we are sure that will continue into the future.”

Approving the settlement, Mrs Justice Swift also paid tribute to the girl and her parents, adding: “I have read the papers in this case and I have read a great deal about this child, and it is quite plain she is a very determined young lady, who makes the very best of her abilities - of which she has many.

“Sadly, she does have - and will have for the rest of her life - a number of disabilities also, as a result of what has occurred and I just hope that the damages award will enable her to maximise her strengths and to lead a long, useful and comfortable life.

“Another matter that is evident from the papers is the sensitivity and devotion which her parents have shown to her and her needs - no doubt it comes as second nature to them, but to an outsider it is remarkable.”
