Driver who killed cyclist in Newmarket appears in court
A driver charged with the death of a cyclist in Newmarket appeared in court today.
Danut Birle, who lives in Old Station Road, was driving his BMW under the speed limit in Barbara Stradbroke Avenue on January 24 last year when he hit a 34-year-old man and killed him.
Suffolk Magistrates Court heard that the victim was wearing a high-viz jacket and riding a well-lit bicycle and should have been clearly visible on the road.
The court also heard that police officers had re-enacted the scene to be sure that the cyclist would have been visible to the driver at that particular time of day.
Birle was driving 48 miles per hour in a 60 zone.
The magistrate decided to refer the case to the Crown Court, where they have higher sentencing powers.
Birle, 23, was bailed and will appear again on February 5 at 9.30am.
